End User License Agreement (EULA)

1. ELIGIBILITY AND AGE RESTRICTIONS
a) The Application is intended for users who are at least 17 years of age or older, with some regional variations:
- Users in France must be 18 years or older
- Users in Brazil must be 18 years or older (A18)
- Other regions may have specific age requirements based on local laws
b) By using the Application, you represent and warrant that you meet the applicable age requirement for your region. If you are not of legal age to form a binding contract in your jurisdiction, you may not use the Application.
2. RESPONSIBLE USE AND DISCLAIMER
a) Soda Vault promotes responsible consumption of beverages. The information provided in the Application is for informational purposes only and should not encourage excessive or irresponsible consumption of alcoholic beverages.
b) Users are advised to:
- Always drink responsibly and in moderation
- Never drink and drive
- Comply with all local laws regarding alcohol consumption
- Be aware that alcohol consumption may be harmful to health
- Not rely on the Application for medical or health advice
c) The Application's content is not intended to promote excessive alcohol consumption or underage drinking.
3. LICENSE GRANT AND RESTRICTIONS
a) License Grant:
By downloading, installing, or using the Application, Soda Vault grants you a revocable, non-exclusive, non-transferable, limited license to use the Application solely for your personal, non-commercial purposes strictly in accordance with this Agreement.
b) Restrictions:
You agree not to, and will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Application
- Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Soda Vault or its affiliates, partners, suppliers or licensors
4. PURCHASES, POINTS AND REWARDS
a) The Application offers in-app point pack purchases, processed through the platform's app store (Apple App Store or Google Play Store).
b) Points and Rewards:
- Users earn points through in-app activities (such as hearting drinks, trying drinks, and daily logins) or by purchasing point packs
- Points can be redeemed for in-app rewards
- Points have no monetary value and cannot be exchanged for cash
- Soda Vault reserves the right to modify point values, earning rates, and available rewards at any time
c) Refund Policy:
- Refund requests for point pack purchases must be made through the applicable app store (Apple App Store or Google Play Store)
- Soda Vault does not directly process refunds as all payments are handled by the respective app store
5. CONTENT AND USER SUBMISSIONS
a) Database Content: The Application provides access to a database of beverage information. While we strive to maintain accurate and up-to-date information, the content is provided "as is" and you acknowledge that Soda Vault does not warrant the accuracy, completeness, or reliability of any beverage information provided through the Application.
b) User-Generated Content: The Application allows users to create and submit the following types of content ("User Content"):
- Custom drink entries (can be public or private)
- Collections of drinks (can be public or private)
- Ratings for drinks
- Private notes for drinks
- Tried drink logs, including flavor profiles, comments, photos, and make-again preferences
- Profile information such as display name and location
When submitting public User Content (such as public drink entries and collections), you:
- Grant Soda Vault a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such public User Content
- Represent that you own or have the necessary rights to submit such User Content
- Agree not to post content that is illegal, offensive, abusive, or infringes on others' rights
- Understand that Soda Vault reserves the right to remove any public User Content at its sole discretion
- Acknowledge that other users may save your public collections to their own accounts
For private User Content (private drink entries, collections, and notes):
- This content remains private to your account and is only visible to you
- Soda Vault will only use this content to provide and improve the service
- You maintain full control over your private content and can modify or delete it at any time
- You can convert private content to public at any time, at which point it will be subject to the public content terms above
c) Content Moderation: Soda Vault reserves the right to monitor, edit, or remove any User Content that violates these terms or is deemed inappropriate, without prior notice.
6. DATA COLLECTION AND PRIVACY
The Application collects and stores personal information, including:
a) User ID for account identification
b) Email address for account management and communication
c) Profile information you provide, such as display name and location
d) User-generated content including custom drinks, collections, ratings, notes, tried drink logs (with flavor profiles, comments, and photos), and make-again preferences
e) Points and rewards activity, including earning and redemption history
Additionally, the Application collects anonymized usage analytics to provide brand partners with aggregated performance metrics. This includes:
a) Page views, collection views, and ingredient interactions attributed to brand partner content
b) Aggregated counts of user actions such as hearting or trying drinks that contain brand partner ingredients
c) A truncated, one-way hash derived from your authentication token ("session hash") used solely for estimating unique visitor counts — this hash cannot be used to identify you or reconstruct your token
This analytics data is collected automatically as you interact with brand partner content within the Application. It is provided to brand partners only in aggregated, anonymized form (e.g., "247 profile views this month"). No personally identifiable information is shared with brand partners. Raw event data is retained for 90 days and then permanently deleted; only aggregate statistics are kept thereafter.
This information is used solely for the purpose of providing and improving the Application's services. Your use of the Application is also subject to our Privacy Policy, which is incorporated into this Agreement by reference.
We implement appropriate security measures to protect your personal information and will not sell, rent, or lease your personal data to third parties without your explicit consent.
7. APP STORE RELATIONSHIP
a) You acknowledge that this Agreement is concluded between you and Soda Vault only, and not with any app store provider (Apple, Inc. or Google LLC).
b) Soda Vault, not the app store provider, is solely responsible for the Application and its content, maintenance, support services, and warranty. The app store provider has no obligation to provide any maintenance or support services for the Application.
c) In the event of any failure of the Application to conform to any applicable warranty, you may notify the applicable app store provider, who may refund the purchase price for the Application. To the maximum extent permitted by applicable law, the app store provider will have no other warranty obligation whatsoever with respect to the Application.
d) The app store provider is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to:
- Product liability claims
- Any claim that the Application fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection or similar legislation
e) For iOS users: Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
8. NO WARRANTY
The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Soda Vault expressly disclaims all warranties, whether express, implied, statutory, or otherwise.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Soda Vault be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in connection with your access or use of the Application.
10. TERMINATION
This Agreement is effective until terminated by you or Soda Vault. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.
11. CHANGES TO THIS AGREEMENT
Soda Vault reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
12. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for the resolution of any dispute relating to this Agreement.
